Do you own a stove, range, or oven featuring the proprietary “AquaLift® Self-Cleaning Technology?”
On June 27, 2016, Harford, P.C., has joined together with two other law firms in filing a class action lawsuit on behalf of every person who has purchased a Whirlpool, Maytag, KitchenAid, or Jen-Air oven equipped with an “AquaLift” technology in the United States.
The ovens are promoted to consumers to self-clean in less than one hour using only water and low heat. In purchasing these ovens, the class action alleges consumers were led to believe they could avoid the 3-6 hours of traditional self-cleaning ovens along with the corresponding foul odor, chemicals, and high temperature.
Whirlpool, the manufacturer of these AquaLift ovens, describes AquaLift as “oven cleaning redefined,” “innovation nearly 50 years in the making,” and a “first-of-its kind cleaning solution.” It emphasizes that consumers can use the technology to eliminate “tough baked-on soils” in only 40-50 minutes.
The class action lawsuit, filed in the U.S. District Court for the Eastern District of Michigan (2:16-cv-12409), claims the AquaLift feature does not perform as advertised and requires consumers to purchase cleaning supplies to manually clean and scrub their ovens. It seeks damages and injunctive relief for violations of the Magnuson-Moss Warranty Act, various warranty and consumer fraud statutes and other common law claims.
