An alarming recall occurred in December 2023 by the company CooperSurgical after receiving a “sudden increase” in the number of complaints about its media used to nurture embryos that are later implanted into a uterus. The “urgent” recall notice concerns three lots of its solution, noting “the risk to health is impaired embryo development prior to the blastocyst stage.”
Patients are accusing CooperSurgical of not conducting sufficient testing of their embryo culture media, and thereby destroying irreplaceable embryos. In fact, just this past month, two couples in Los Angeles filed suit asserting the toxic solution destroyed their developing embryos. Another case was recently filed in Massachusetts federal court.
In vitro fertilization is the most common type of assisted reproductive technology in the United States. The process entails extracting eggs from a woman, which are then fertilized with sperm to create a viable embryo, which is then later implanted into the uterus. But it is necessary to store the embryos for a period of time prior to implantation, and the embryos must be carefully preserved with a culture media.
CooperSurgical markets its media as “an optimized environment” for the culture and development of fertilized eggs. Based on the recent recall and lawsuits, it appears CooperSurgical is wrong.
Harford, P.C. is now accepting cases for patients who were affected by this recall. It expects to be filing numerous lawsuits regarding this recall within the next few months.
