Harford, P.C. is now lead counsel in all fifteen (15) cases alleging catastrophic injuries from two (2) separate Legionella outbreaks from the cooling towers at the Sugar Hill Project located in the West Harlem and Washington Heights section of Manhattan in the Summer of 2018. Among our clients, seven were inflicted with Legionella exposure from the first outbreak in June, and the remaining eight from the second outbreak in late September.
Two of our clients are now deceased from the second outbreak and several others remain completely debilitated requiring full-time medical and at-home care.
The Defendants are the owner of the Sugar Hill Project—Broadway Housing Communities, Inc.—and the company entrusted with the maintenance of the cooling tower—Clarity Water Technologies, LLC.
During the litigation, we have completed the discovery depositions of the Defendants’ corporate representatives and further produced each of our clients for depositions. Harford, P.C. has also reviewed thousands of documents produced by the defendants relating to the maintenance and upkeep of the cooling at the Sugar Hill Project.
There are strict statutory laws in New York requiring owners to properly maintain their cooling towers to prevent Legionella outbreaks. For instance, owners must conduct water quality testing, perform regular inspections, daily chemical treatments, and ninety (90) day Legionella culture sampling.
It is Plaintiffs’ contention in this litigation that Defendants’ failure to perform these required activities was the reason behind this unprecedented outbreak. In the end, it was the first time in New York City history that the same building was responsible for two separate Legionella outbreaks.
