The “all purpose” Roundup weed killer manufactured by Monsanto has been found by the California Environmental Protection Agency (“CEPA”) to cause cancer. The governmental agency will add the main compound of Roundup—glyphosate—to its state-wide list created under the Safe Drinking Water & Toxic Enforcement Act of 1986, or Proposition 65. This act mandates the state government to maintain a list of naturally occurring or synthetic chemicals known to cause cancer or birth defects or other reproductive harm.
The finding by the CEPA follows the July 2015 final assessment by the International Agency for Research on Cancer determining that glyphosate is “probably carcinogenic to humans.”
There is approximately 250 million pounds of glyphosate sprayed on crops, lawns, driveways, parks, and golf courses. The product is used by farmers, homeowners, and landscapers throughout the United States. Monsanto does not include any warnings on any of its Roundup product concerning the risk of cancer.
There is currently a multi-district litigation pending in the U.S. District Court in San Francisco before Judge Vince Chhabria. The litigation currently has 91 lawsuits by individuals exposed to Roundup who developed non-Hodgkin’s lymphoma. The cases have been consolidated for purposes of discovery and pre-trial proceedings before Judge Chhabria.
