Claimants suffering from melanoma as a result of using Viagra will now have the opportunity to litigate their claims in a centralized litigation. On April 7, 2016, a panel of federal judges ordered that the 14 filed pending federal cases located throughout the United States be consolidated in the U.S. District Court for the Northern District of California. These lawsuits accuse Pfizer, the manufacturer of Viagra, of negligence for failing to warn consumers of the risk of melanoma.
According to the panel of federal judges, this “centralization will eliminate duplicative discovery, prevent inconsistent pretrial rulings on Daubert and other issues, and conserve the resources of the parties, their counsel, and the judiciary.” A centralization of federal cases has many of the advantages of a class action, such as improving efficiency, convenience, and cost.
A recent study at the Harvard School of Public Health published by JAMA Internal Medicine concluded that users of Viagra had an 84% increased risk of melanoma. The study was based on 10 years of data on 25,000 healthcare professionals within the United States.
